00 HOUSE BILL NO. 377 01 "An Act relating to the per diem allowance for members of the legislature." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.10.130(b) is amended to read: 04 (b) Legislators and officers and employees of the legislative branch of 05 government may be entitled to a per diem allowance; however, a member of the 06 legislature is not entitled to a per diem allowance for a day the legislature is in 07 session at a location 08 (1) outside of the capital city, if the member's principal place of 09 residence is less than 30 miles from the location; or 10 (2) in the capital city, if the member's principal place of residence 11 is in the City and Borough of Juneau. 12 * Sec. 2. AS 24.10.130(c) is amended to read: 13 (c) The Alaska Legislative Council shall adopt a policy in accordance with (b) 14 of this section and AS 39.23.540(d) regarding reimbursement for moving expenses 15 [APPLICABLE TO ALL LEGISLATORS] and payment of a [AN APPLICABLE]

01 per diem allowance [POLICY]. The policy must apply to all members of the 02 legislature and must set conditions for the reimbursement for moving expenses and 03 payment of per diem and prescribe the amounts of reimbursement adapted to the 04 special needs of the legislative branch as determined by the council. 05 * Sec. 3. AS 39.23.540(d) is amended to read: 06 (d) The commission shall make available to the governor and presiding 07 officers of each house of the legislature a final report of its findings and 08 recommendations as to the rate and form of compensation, benefits, and allowances 09 for legislators, the governor, the lieutenant governor, and each principal executive 10 department head during the first 10 days of a legislative session. Subject to (g) of this 11 section and AS 24.10.130(b), and unless a bill disapproving all the recommendations 12 for all officers listed in this section is enacted into law within 60 days after the 13 recommendations are submitted to the governor and presiding officers of each house 14 of the legislature, a recommendation as to the compensation, benefits, and allowances 15 for 16 (1) a legislator has the force of law and becomes effective on the first 17 day of the next regular legislative session; and 18 (2) the governor, the lieutenant governor, and each principal executive 19 department head has the force of law and becomes effective on the first day of the 20 fiscal year following the fiscal year in which the recommendation is submitted.
