00 HOUSE BILL NO. 322 01 "An Act limiting employee compensation for certain officers and employees in the 02 exempt service; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 39.25.110 is amended by adding new subsections to read: 05 (b) Notwithstanding another provision of law, a person who holds a position 06 in the exempt service under (a) of this section may not be paid a monthly base salary 07 that exceeds the monthly base salary paid to the governor. This subsection does not 08 apply to 09 (1) the president of the University of Alaska; 10 (2) the president of the Alaska Gasline Development Corporation and 11 up to three officers or employees of the corporation designated by the corporation; 12 (3) petroleum engineers and petroleum geologists employed in a 13 professional capacity by the Department of Natural Resources; 14 (4) justices, judges, and magistrates of the judicial branch;

01 (5) officers and employees of the Alaska Permanent Fund Corporation; 02 (6) the state medical examiner appointed under AS 12.65.015. 03 (c) If the governor determines it is in the best interest of the state to make an 04 exception to the limitation in (b) of this section for a particular executive branch 05 position in the exempt service, the governor shall deliver a report to the senate 06 secretary and the chief clerk of the house of representatives and notify the legislature 07 that the report is available. The report must include a description of the position and 08 the salary the governor recommends. 09 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 APPLICABILITY. AS 39.25.110(b) and (c), enacted by sec. 1 of this Act, apply to 12 contracts entered into on or after the effective date of this Act. 13 * Sec. 3. This Act takes effect July 1, 2016.
