01 "An Act relating to school districts; and relating to layoff plans for tenured teachers."                               
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 14.20.177(a) is amended to read:                                                                   
04            (a)  A school district may implement a layoff plan under this section if it is                               
05       necessary for the district to reduce the number of tenured teachers [BECAUSE                                      
06                 (1)  SCHOOL ATTENDANCE IN THE DISTRICT HAS                                                              
07       DECREASED; OR                                                                                                     
08                 (2)  THE BASIC NEED OF THE SCHOOL DISTRICT                                                              
09       DETERMINED UNDER AS 14.17.410(b)(1) DECREASES BY THREE PERCENT                                                    
10       OR MORE FROM THE PREVIOUS YEAR].                                                                                  
11    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
12 read:                                                                                                                   
13       APPLICABILITY. AS 14.20.177(a), as amended by sec. 1 of this Act, applies to a                                    
14 contract or collective bargaining agreement entered into on or after the effective date of this                         
15 Act.
