00 SENATE BILL NO. 41 01 "An Act relating to student participation in interscholastic activities in religious and 02 other private schools; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.45 is amended by adding a new section to article 3 to read: 05 Sec. 14.45.150. Interscholastic activities; eligibility. (a) A full-time student 06 who is eligible under (b) of this section who is enrolled in grades nine through 12 in an 07 alternative education program that is located entirely in the state and that does not 08 offer interscholastic activities is eligible to participate in any interscholastic activities 09 program available in a religious or other private school regulated under this chapter 10 (1) that the student would be eligible to attend were the student not 11 enrolled in an alternative education program; and 12 (2) at which the student requests to participate, if the administrator of 13 the school approves. 14 (b) A student is eligible to participate in interscholastic activities under this

01 section if the student 02 (1) is otherwise eligible to participate in interscholastic activities under 03 requirements established by the school and the statewide interscholastic activities 04 governing body; 05 (2) provides documentation, including academic transcripts, proof of 06 full-time enrollment, and applicable disciplinary records, and, if required for 07 participation in an activity by the school, requested medical records, to the school 08 providing the interscholastic activities program; and 09 (3) claims the same school for interscholastic activities eligibility 10 purposes during a school year. 11 (c) In this section, 12 (1) "alternative education program" means a public secondary school 13 that provides a nontraditional education program, including the Alaska Military Youth 14 Academy; a public vocational, remedial, or theme-based program; a home school 15 program that is accredited by a recognized accrediting body; a charter school 16 authorized under AS 14.03.250 - 14.03.290; and a statewide correspondence school 17 that enrolls students who reside outside of a district in which the student resides and 18 provides less than three hours a week of scheduled face-to-face student interactions in 19 the same location with a teacher who is certified under AS 14.20.020; 20 (2) "district" has the meaning given in AS 14.17.990; 21 (3) "full-time student" means a student who 22 (A) is enrolled in not less than five classes in grades nine 23 through 11 and not less than four classes in grade 12; and 24 (B) is on track to graduate from secondary school in not more 25 than four years of attendance in secondary school; 26 (4) "interscholastic activities" means preparation for and participation 27 in events or competitions involving another school when the preparation or 28 participation 29 (A) is sanctioned or supported by the statewide interscholastic 30 activities governing body; 31 (B) is conducted outside of the regular school curriculum; and

01 (C) does not involve participation in student government at a 02 school. 03 * Sec. 2. This Act takes effect July 1, 2013.
