00 HOUSE BILL NO. 330 01 "An Act requiring motor vehicle dealers to provide written disclosure of employee 02 commissions relating to service sales." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 45.25 is amended by adding a new section to read: 05 Sec. 45.25.540. Written disclosure of service commissions. (a) If a services- 06 related employee of a motor vehicle dealer receives a commission for the amount of 07 work the employee performs, the motor vehicle dealer may not sell the services to a 08 person unless the person, before agreeing to purchase the services, signs a written 09 statement that complies with (b) of this section. 10 (b) The written statement required by (a) of this section must specify that the 11 motor vehicle dealer pays commissions to one or more of the employees who perform 12 or administer the services, including an employee who receives, analyzes, or refers 13 requests for services; the statement must be clearly written in a type size that is not 14 smaller than 14 points, and the word "commission" or "commissions" must be

01 underlined. 02 (c) This section does not apply to service contracts under AS 45.25.620. 03 (d) In this section, 04 (1) "services" means motor vehicle maintenance or repair services; 05 (2) "services-related employee" means an employee who performs the 06 services or administers the services; in this paragraph, "administers the services" 07 includes receiving, analyzing, or referring requests for services.
