00 HOUSE BILL NO. 322 01 "An Act requiring the Department of Transportation and Public Facilities to involve the 02 public and to consider comments regarding the design, construction, and mitigation 03 elements of a project." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 19.05.030 is amended to read: 06 Sec. 19.05.030. Duties of department. The department has the following 07 duties: 08 (1) direct approved highway planning and construction and 09 maintenance, protection and control of highways; 10 (2) employ assistants and employees; 11 (3) certify and approve vouchers; 12 (4) provide a program of highway research; 13 (5) prepare a budget; 14 (6) review the annual highway program;
01 (7) develop and implement an avalanche control plan to protect 02 persons who use public highways; 03 (8) solicit and consider comments and preferences regarding the 04 design, construction, and mitigation elements of a project from the public, 05 including the community and organized stakeholders in the area in which a 06 project is located.
