00 CS FOR HOUSE BILL NO. 309(L&C) 01 "An Act relating to distillery licenses." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 04.11.170(b) is amended to read: 04 (b) A distillery license authorizes the holder to sell alcoholic beverages [TO 05 PERSONS LICENSED UNDER THIS CHAPTER] in 06 (1) quantities of not more than one gallon a day to a person who is 07 present on the licensed premises for consumption off the premises; 08 (2) any amount to a person who is licensed under this title or in 09 another state or country [FIVE GALLONS]. 10 * Sec. 2. AS 04.11.170 is amended by adding new subsections to read: 11 (d) The holder of a distillery license may permit a person to sample small 12 portions of the distillery's product free of charge unless prohibited by AS 04.16.030. 13 (e) Unless prohibited by AS 04.16.030, a holder of a distillery license may sell 14 not more than three ounces a day of the distillery's product to a person for 15 consumption on the premises if

01 (1) the distillery does not allow live entertainment, televisions, pool 02 tables, dart games, dancing, electronic or other games, game tables, or other 03 recreational or gaming opportunities on the premises where the consumption occurs; 04 (2) the distillery does not provide seats at the counter or bar where the 05 product is served; and 06 (3) the room where the consumption occurs is not open before 9:00 07 a.m. and serving of the product ends not later than 8:00 p.m. 08 * Sec. 3. AS 04.21.025(a) is amended to read: 09 (a) As a condition of issuance or renewal of a license and selling alcoholic 10 beverages under a license, the board shall require a licensee who sells or serves 11 alcoholic beverages and a licensee's agents and employees who sell or serve alcoholic 12 beverages or check the identification of a patron to complete an alcohol server 13 education course approved by the board, if the license is for a 14 (1) beverage dispensary; 15 (2) restaurant or eating place; 16 (3) club; 17 (4) package store; 18 (5) recreational site; 19 (6) pub; 20 (7) distillery; 21 (8) conditional contractor. 22 * Sec. 4. AS 04.21.065(a) is amended to read: 23 (a) A holder of one of the following types of licenses or permits shall post on 24 the licensed or designated premises three separate warning signs as described in (b) of 25 this section: 26 (1) beverage dispensary license; 27 (2) restaurant or eating place license; 28 (3) club license; 29 (4) brewery license; this paragraph applies only to a brewery that 30 permits a person to sample portions of the brewery's product; 31 (5) package store license;

01 (6) common carrier dispensary license; 02 (7) recreational site license; 03 (8) pub license; 04 (9) winery license; this paragraph applies only to a winery that permits 05 a person to sample portions of the winery's product; 06 (10) distillery license; this paragraph applies only to a distillery 07 that permits a person to sample portions of the distillery's product; 08 (11) caterer's permit; 09 (12) [(11)] special events permit; 10 (13) [(12)] conditional contractor's permit; 11 (14) [(13)] another license or permit issued by the board authorizing 12 consumption of alcoholic beverages.
