00 CS FOR HOUSE BILL NO. 268(FIN) 01 "An Act relating to big bull moose derbies and the Snow Town Ice Classic; and relating 02 to permits for games of chance and contests of skill." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 05.15.060(a) is amended to read: 05 (a) The department shall adopt regulations under AS 44.62 (Administrative 06 Procedure Act) necessary to carry out this chapter covering, but not limited to, 07 (1) the issuance, renewal, and revocation of permits, licenses, and 08 vendor registrations; 09 (2) a method of ascertaining net proceeds, the determination of items 10 of expense that may be incurred or paid, and the limitation of the amount of the items 11 of expense to prevent the proceeds from the activity permitted from being diverted to 12 noncharitable, noneducational, nonreligious, or profit-making organizations, 13 individuals, or groups; 14 (3) the immediate revocation of permits, licenses, and vendor

01 registrations authorized under this chapter if this chapter or regulations adopted under 02 it are violated; 03 (4) the requiring of detailed, sworn, financial reports of operations 04 from permittees and licensees including detailed statements of receipts and payments; 05 (5) the investigation of permittees, licensees, registered vendors, and 06 their employees, including the fingerprinting of those permittees, licensees, registered 07 vendors, and employees whom the department considers it advisable to fingerprint; 08 (6) the method and manner of conducting authorized activities and 09 awarding of prizes or awards, and the equipment that may be used; 10 (7) the number of activities that may be held, operated, or conducted 11 under a permit during a specified period; however, the department may not allow more 12 than 14 bingo sessions a month and 35 bingo games a session to be conducted under a 13 permit; the holders of a multiple-beneficiary permit under AS 05.15.100(d) may hold, 14 operate, or conduct the number of sessions and games a month equal to the number 15 allowed an individual permittee per month multiplied by the number of holders of the 16 multiple-beneficiary permit; 17 (8) a method of accounting for receipts and disbursements by 18 operators, including the keeping of records and requirements for the deposit of all 19 receipts in a bank; 20 (9) the disposition of funds in possession of a permittee, a person, 21 municipality, or qualified organization that possesses an operator's license, or a 22 registered vendor at the time a permit, a license, or a vendor registration is 23 surrendered, revoked, or invalidated; 24 (10) restrictions on the participation by employees of the Department 25 of Fish and Game in salmon classics, [AND IN] king salmon classics, and big bull 26 moose derbies, and by employees of Douglas Island Pink and Chum in king salmon 27 classics; 28 (11) other matters the department considers necessary to carry out this 29 chapter or protect the best interest of the public. 30 * Sec. 2. AS 05.15.100(a) is amended to read: 31 (a) The department may issue a permit to a municipality or qualified

01 organization. The permit gives the municipality or qualified organization the privilege 02 of conducting bingo, raffles and lotteries, pull-tab games, ice classics, race classics, 03 rain classics, goose classics, mercury classics, deep freeze classics, canned salmon 04 classics, salmon classics, king salmon classics, dog mushers' contests, snow classics, 05 snow machine classics, fish derbies, animal classics, crane classics, cabbage classics, 06 Calcutta pools, big bull moose derbies, and contests of skill. 07 * Sec. 3. AS 05.15.115(c) is amended to read: 08 (c) A permittee may not contract with more than one operator at a time to 09 conduct the same type of activity. For the purposes of this subsection, bingo games, 10 raffles, lotteries, pull-tab games, ice classics, race classics, rain classics, goose 11 classics, mercury classics, deep freeze classics, canned salmon classics, salmon 12 classics, king salmon classics, dog mushers' contests, snow classics, snow machine 13 classics, fish derbies, animal classics, crane classics, cabbage classics, big bull moose 14 derbies, and contests of skill are each a different type of activity. 15 * Sec. 4. AS 05.15.180(b) is amended to read: 16 (b) With the exception of raffles, lotteries, bingo games, pull-tab games, race 17 classics, rain classics, goose classics, mercury classics, deep freeze classics, dog 18 mushers' contests, snow classics, snow machine classics, canned salmon classics, 19 salmon classics, animal classics, crane classics, cabbage classics, Calcutta pools, big 20 bull moose derbies, and king salmon classics, a permit may not be issued for an 21 activity [MAY NOT BE LICENSED] under this chapter unless it existed in the state 22 in substantially the same form and was conducted in substantially the same manner 23 before January 1, 1959. A permit may not be issued for a snow machine classic 24 [MAY NOT BE LICENSED] under this chapter unless it has been in existence for at 25 least five years before the permit is issued [LICENSING]. A permit may not be 26 issued for an [AN] animal classic [MAY NOT BE LICENSED] under this chapter 27 unless it was in existence before November 1, 2002. 28 * Sec. 5. AS 05.15.690(26) is amended to read: 29 (26) "ice classic" means a game of chance where a prize of money is 30 awarded for the closest guess of the time the ice moves in a body of water or 31 watercourse in the state and is limited to the Nenana and Chena Ice Pools in the same

01 manner as they were conducted in 1959 and previous years, a Kuskokwim Ice Classic 02 to be operated and administered by Bethel Community Services Foundation, Inc., a 03 Kenai River Ice Classic to be operated and administered by the Kenai and Soldotna 04 Rotary Clubs jointly or by either the Kenai Rotary Club or the Soldotna Rotary Club, a 05 Yukon River Ice Classic to be operated and administered by the City of Fort Yukon, 06 an Alaska-Soviet Ice Classic to be operated and administered jointly by CAMAI, Inc., 07 and the City of Diomede, a Big Lake Ice Classic to be operated and administered by 08 the Houston Junior-Senior High School Booster Club and the Big Lake Chamber of 09 Commerce jointly or by either the Houston Junior-Senior High School Booster Club 10 or the Big Lake Chamber of Commerce, [AND] a McGrath Ice Classic to be operated 11 and administered by the Kuskokwim Public Broadcasting Company, and the Snow 12 Town Ice Classic to be operated and administered by the Advocates for Victims 13 of Violence, Inc.; 14 * Sec. 6. AS 05.15.690 is amended by adding a new paragraph to read: 15 (50) "big bull moose derby" means a contest in which prizes are 16 awarded based on the size or spread of moose antlers.
