01 "An Act relating to harassment, intimidation, or bullying by students attending a public                                
02 school in the state."                                                                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 14.33.220(b) is amended to read:                                                                   
05            (b)  A school employee, student, or volunteer who has witnessed, or has                                      
06       reliable information that a student has been subjected to, harassment, intimidation, or                           
07       bullying [, WHETHER VERBAL OR PHYSICAL,] shall report the incident to an                                          
08       appropriate school official.                                                                                      
09    * Sec. 2. AS 14.33.250(2) is amended to read:                                                                      
10                 (2)  "harassment, intimidation, or bullying" means an intentional                                       
11       written, electronic, or oral communication, or physical act, when the                                     
12       communication or act is undertaken with the intent of threatening, intimidating,                              
13       harassing, or frightening the student, and                                                                        
14                      (A)  physically harms the student or damages the student's                                         

01            property;                                                                                                    
02                      (B)  has the effect of substantially interfering with the student's                                
03            education;                                                                                                   
04                      (C)  is so severe, persistent, or pervasive that it creates an                                     
05            intimidating or threatening educational environment; or                                                      
06                      (D)  has the effect of substantially disrupting the orderly                                        
07            operation of the school;
