00 SENATE BILL NO. 174 01 "An Act requiring certain employers in the oil or gas production industries to report 02 certain job opportunities to the Department of Labor and Workforce Development as 03 public information and requiring that information to be posted on the Alaska Online 04 Public Notice System; and adding to the duties of the Alaska Workforce Investment 05 Board." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 23.05 is amended by adding a new section to read: 08 Sec. 23.05.095. Notification by oil or gas producer of certain job vacancies. 09 (a) An oil or gas producer that employs more than 100 employees in Alaska shall 10 notify the commissioner promptly and in writing each time the producer has an 11 available job opportunity in the state. The notification, which may be delivered 12 electronically or by another reasonable means, must provide information sufficient to 13 enable a person who may be qualified for the job opportunity to submit a timely

01 application. 02 (b) As soon as practicable after receiving a notification under (a) of this 03 section, the commissioner shall cause the notification to be 04 (1) posted on the Alaska Online Public Notice System under 05 AS 44.62.175; 06 (2) distributed to job service organizations; and 07 (3) delivered to the chair of the employment and placement committee 08 of the Alaska Workforce Investment Board. 09 (c) A notification under this section is public information. 10 (d) Notification of an available job opportunity under this section is not 11 required when 12 (1) the employer advertises the opportunity and notifies job service 13 organizations as required under AS 43.82.230(b); or 14 (2) public notice of the availability of the opportunity is reasonably 15 likely to cause substantial financial harm to the employer. 16 (e) In this section, 17 (1) "gas" has the meaning given in AS 31.05.170; 18 (2) "job service organizations" means those offices maintained by the 19 state and recommended by the Department of Labor and Workforce Development 20 whose functions are to aid the unemployed or underemployed in finding employment; 21 (3) "oil" has the meaning given in AS 31.05.170; 22 (4) "producer" means a person who owns or operates a for-profit 23 business that is substantially connected with exploration for, production of, or pipeline 24 transportation of gas or unrefined oil. 25 * Sec. 2. AS 23.15.570(f) is amended to read: 26 (f) The employment and placement committee shall 27 (1) ensure the statewide strategic plan for workforce development 28 addresses 29 (A) customer needs at the local level; 30 (B) moving welfare recipients into the workforce; 31 (C) promoting the hiring of state residents in jobs that have

01 traditionally been filled by out-of-state workers; 02 (D) tailoring employment and training programs to suit state 03 business, industry, and economic development needs; 04 (E) making state residents aware of notifications provided 05 to the commissioner under AS 23.05.095 regarding available job 06 opportunities with oil or gas producers; 07 (2) monitor the coordination of service delivery to promote efficiency 08 and to prevent overlap of services among programs; and 09 (3) perform other duties assigned by the board. 10 * Sec. 3. AS 44.62.175(a) is amended to read: 11 (a) The lieutenant governor shall develop and supervise the Alaska Online 12 Public Notice System, to be maintained on the state's site on the Internet. The 13 lieutenant governor shall prescribe the form of notices posted on the system by state 14 agencies. The Alaska Online Public Notice System must include 15 (1) notices of proposed actions given under AS 44.62.190(a); 16 (2) notices of state agency meetings required under AS 44.62.310(e), 17 even if the meeting has been held; 18 (3) notices of solicitations to bid issued under AS 36.30.130; 19 (4) notices of state agency requests for proposals issued under 20 AS 18.55.255, 18.55.320; AS 36.30.210; AS 37.05.316; AS 38.05.120; and 21 AS 43.40.010; 22 (5) executive orders and administrative orders issued by the governor; 23 (6) written delegations of authority made by the governor or the head 24 of a principal department under AS 44.17.010; 25 (7) the text or a summary of the text of a regulation or order of repeal 26 of a regulation for which notice is given under AS 44.62.190(a), including an 27 emergency regulation or repeal regardless of whether it has taken effect; 28 (8) notices required by AS 44.62.245(b) regarding an amended version 29 of a document or other material incorporated by reference in a regulation; 30 (9) a summary of the text of recently issued formal opinions and 31 memoranda of advice of the attorney general;

01 (10) a list of vacancies on boards, commissions, and other bodies 02 whose members are appointed by the governor; [AND] 03 (11) in accordance with AS 39.52.240(h), advisory opinions of the 04 attorney general; and 05 (12) notifications received by the commissioner of labor and 06 workforce development under AS 23.05.095.
