00 HOUSE BILL NO. 321 01 "An Act requiring certain airports in the state to apply for the federal security screening 02 opt-out program; providing reimbursement to a municipality that applies for the federal 03 security screening opt-out program; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 06 to read: 07 APPLICATION FOR FEDERAL SECURITY SCREENING OPT-OUT PROGRAM. 08 (a) The Department of Transportation and Public Facilities shall, by December 31, 2013, 09 apply for the federal security screening opt-out program under 49 U.S.C. 44920 for those 10 airports under the control of the Department of Transportation and Public Facilities that are 11 subject to federal security screening requirements. 12 (b) A municipality that operates an airport in the state that is subject to federal 13 security screening requirements shall, by December 31, 2013, apply for the federal security 14 screening opt-out program under 49 U.S.C. 44920.

01 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 02 read: 03 REIMBURSEMENT. Subject to appropriation, the Department of Transportation and 04 Public Facilities shall reimburse a municipality that is required to submit an application under 05 sec. 1(b) of this Act for the reasonable costs, as determined by the Department of 06 Transportation and Public Facilities, of applying for the federal security screening opt-out 07 program under 49 U.S.C. 44920. If appropriations are not sufficient fully to fund 08 reimbursements under this section, the amount available shall be distributed pro rata among 09 eligible municipalities. 10 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
