00 CS FOR HOUSE BILL NO. 183(FIN) am 01 "An Act relating to the Village Safe Water Act; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 46.07.080(2) is repealed and reenacted to read: 04 (2) "village" means 05 (A) a second class city; 06 (B) a first class city with a population of less than 1,000; 07 (C) a home rule municipality with a population of less than 08 1,000; 09 (D) the Annette Island Reserve established by 25 U.S.C. 495 10 for the Metlakatla Indian Community; 11 (E) a community with a population between 25 and 1,000 that 12 is represented by 13 (i) a council organized under 25 U.S.C. 476 (sec. 16 of 14 the Indian Reorganization Act); 15 (ii) a traditional village council recognized by the

01 United States as eligible for federal aid to Indians; or 02 (iii) an incorporated nonprofit entity or Native village 03 council that the Department of Commerce, Community, and Economic 04 Development, with advice from the Department of Law, has 05 determined is eligible to receive and spend a community revenue 06 sharing payment under AS 29.60.865, if the incorporated nonprofit 07 entity or Native village council agrees to act as a village governing 08 body for the purposes of this chapter and provides for the ongoing 09 maintenance of a project funded under this chapter. 10 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 11 read: 12 TRANSITION. Notwithstanding AS 46.07.080(2), repealed and reenacted by this Act, 13 a village for which Village Safe Water Act project funding was appropriated in a capital 14 budget bill approved by the legislature for a fiscal year before fiscal year 2012 shall remain 15 eligible to receive that Village Safe Water Act project funding after the effective date of this 16 Act regardless of whether the village meets the definition of "village" in AS 46.07.080(2), 17 repealed and reenacted by this Act. 18 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
