00 HOUSE BILL NO. 116 am 01 "An Act making corrective amendments to the Alaska Statutes as recommended by the 02 revisor of statutes by correcting the spellings of 'oxymorphone' and 'lorazepam' and 03 providing an applicability section; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 11.71.140(b) is amended to read: 06 (b) Schedule IA includes, unless specifically excepted or listed in another 07 schedule, any of the following substances whether produced directly or indirectly by 08 extraction from substances of vegetable origin, or independently by means of chemical 09 synthesis, or by a combination of extraction and chemical synthesis: 10 (1) opium and opiate, and any salt, compound, derivative, or 11 preparation of opium or opiate, excluding apomorphine, dextrorphan, nalbuphine, 12 nalmefene, naloxone, and naltrexone, and their respective salts, but including the 13 following: 14 (A) raw opium;
01 (B) opium extracts; 02 (C) opium fluid extracts; 03 (D) powdered opium; 04 (E) granulated opium; 05 (F) tincture of opium; 06 (G) codeine; 07 (H) ethylmorphine; 08 (I) etorphine hydrochloride; 09 (J) hydrocodone; 10 (K) hydromorphone; 11 (L) metopon; 12 (M) morphine; 13 (N) oxycodone; 14 (O) oxymorphone [OXYMORPHINE]; 15 (P) thebaine; 16 (2) any salt, compound, derivative, or preparation of a substance 17 included in (b)(1) of this section which is chemically equivalent or identical to any of 18 the substances referred to in (b)(1) of this section; however, these substances do not 19 include the isoquinoline alkaloids of opium; 20 (3) opium poppy and poppy straw; 21 (4) concentrate of poppy straw which is the crude extract of poppy 22 straw in either liquid, solid, or powder form which contains the phennanthrine 23 alkaloids of the opium poppy; 24 (5) 2-methylamino-1-phenylpropan-1-one, also known as 25 methcathinone and cat. 26 * Sec. 2. AS 11.71.170(b) is amended to read: 27 (b) Schedule IVA includes, unless specifically excepted or unless listed in 28 another schedule, any material, compound, mixture, or preparation which contains any 29 quantity of the following substances, including their salts, isomers and salts of isomers 30 whenever the existence of these salts, isomers, and salts of isomers is possible within 31 the specific chemical designation:
01 (1) barbital; 02 (2) chloral betaine; 03 (3) chloral hydrate; 04 (4) chlordiazepoxide; 05 (5) clonazepam; 06 (6) clorazepate; 07 (7) diazepam; 08 (8) ethclorvynol; 09 (9) ethinamate; 10 (10) flurazepam; 11 (11) lorazepam [LORAZEPAN]; 12 (12) mebutamate; 13 (13) meprobamate; 14 (14) methohexital; 15 (15) methylphenobarbital, also known as mephobarbital; 16 (16) oxazepam; 17 (17) paraldehyde; 18 (18) petrichloral; 19 (19) phenobarbital; 20 (20) prazepam; 21 (21) alprazolam; 22 (22) halazepam; 23 (23) temazepam; 24 (24) triazolam; 25 (25) midazolam; 26 (26) quazepam; 27 (27) flunitrazepam; 28 (28) [REPEALED 29 (29)] ketamine hydrochloride. 30 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 31 read:
01 APPLICABILITY. AS 11.71.140(b)(1)(O), as amended by sec. 1 of this Act, corrects 02 a typographical error in the spelling of "oxymorphone" that has existed since its adoption in 03 Ch. 45, SLA 1982. AS 11.71.170(b)(11), as amended by sec. 2 of this Act, corrects a 04 typographical error in the spelling of "lorazepam" that has existed since its adoption in Ch. 45, 05 SLA 1982. AS 11.71.140(b)(1)(O), as amended by sec. 1 of this Act, and 06 AS 11.71.170(b)(11), as amended by sec. 2 of this Act, apply to crimes committed before, on, 07 or after the effective date of this Act. 08 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
