01 Making arson in the first degree and arson in the second degree serious felonies for purposes                           
02 of application of the crime of conspiracy.

04    * Section 1. AS 11.31.120(h)(2) is amended to read:                                                                
05                 (2)  "serious felony offense" means an offense                                                          
06                      (A)  against the person under AS 11.41, punishable as an                                           
07            unclassified or class A felony;                                                                              
08                      (B)  involving controlled substances under AS 11.71,                                               
09            punishable as an unclassified, class A, or class B felony;                                                   
10                      (C)  that is criminal mischief in the first degree under                                           
11            AS 11.46.475; [OR]                                                                                           
12                      (D)  that is terroristic threatening in the first degree under                                     
13            AS 11.56.807; or                                                                                         
14                      (E)  that is arson in the first degree under AS 11.46.400 or                                   

01            arson in the second degree under AS 11.46.410.
