01 "An Act establishing the Alaska energy efficient small business grant fund and                                          
02 program."                                                                                                               
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 18.56.010 is amended by adding a new subsection to read:                                           
05            (h)  The legislature finds that enabling the Alaska Housing Finance                                          
06       Corporation to expand the concept of the Alaska energy efficient home grant fund to                               
07       assist the owners of small businesses will help to improve energy efficiency                                      
08       throughout the state and provide energy savings for small business owners.                                        
09    * Sec. 2. AS 18.56 is amended by adding a new section to read:                                                     
10           Article 2A. Alaska Energy Efficient Small Business Grant Fund.                                              
11            Sec. 18.56.610. Alaska energy efficient small business grant fund. (a) The                                 
12       Alaska energy efficient small business grant fund is established in the corporation. The                          
13       fund consists of money appropriated to it by the legislature and deposited in it by the                           
14       corporation. The corporation shall administer the Alaska energy efficient small                                   

01       business grant fund under the provisions of this section.                                                         
02            (b)  Subject to appropriation, the corporation may make a grant from the                                     
03       Alaska energy efficient small business grant fund to the owner of a qualifying business                           
04       to retrofit an existing business structure or build a new business structure if the                               
05                 (1)  assessed value of the structure to be retrofitted or constructed with                              
06       the proceeds of the grant does not exceed $1,000,000; and                                                         
07                 (2)  structure to be retrofitted or constructed with the proceeds of the                                
08       grant                                                                                                             
09                      (A)  is owned by a person who is licensed to do business in the                                    
10            state or by persons all of whom are licensed to do business in the state, and                                
11            none of the applicants for the grant has outstanding liabilities to the state at the                         
12            time of making application for the grant under this section; and                                             
13                      (B)  meets other criteria that are adopted by the corporation.                                     
14            (c)  The corporation shall adopt guidelines and procedures setting out the                                   
15       criteria for administration of the Alaska energy efficient small business grant fund.                             
16       Unless the corporation determines that circumstances relating to the award of a grant                             
17       under this section require adoption of a different standard, the guidelines and                                   
18       procedures adopted by the corporation for use under this section shall be those in                                
19       effect as the guidelines and procedures adopted and maintained by the corporation to                              
20       implement the Alaska energy efficient home grant fund under AS 18.56.410.
