00 HOUSE BILL NO. 28 01 "An Act relating to temporary licenses for certain nonresident professionals." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 08.01.062 is repealed and reenacted to read: 04 Sec. 08.01.062. Courtesy licenses. (a) Except as provided in (e) of this 05 section, and notwithstanding another provision of law, a board established under this 06 title and the Department of Commerce, Community, and Economic Development, 07 with respect to an occupation that it regulates under this title, shall by regulation 08 establish criteria for issuing a temporary courtesy license to a nonresident, so that, on a 09 temporary basis, the nonresident person may lawfully practice the person's occupation. 10 (b) A person shall receive a temporary courtesy license under (a) of this 11 section if, at the time of application, the person 12 (1) holds a current license or certificate in another state, district, or 13 territory of the United States with licensure requirements that the department or 14 appropriate board determines are equivalent to those established under this title for 15 that occupation;

01 (2) was engaged in the active practice of the occupation for which the 02 person seeks a temporary license or certificate in a state, district, or territory of the 03 United States for at least two of the five years preceding the date of application under 04 this section; 05 (3) has not committed an act in any jurisdiction that would have 06 constituted grounds for the refusal, suspension, or revocation of a license or certificate 07 to practice that occupation under this title at the time the act was committed; 08 (4) has not been disciplined by a licensing or credentialing entity in 09 another jurisdiction and is not the subject of an unresolved complaint, review 10 procedure, or disciplinary proceeding conducted by a licensing or credentialing entity 11 in another jurisdiction; and 12 (5) pays any fees required under this title. 13 (c) Relevant full-time experience in the discharge of official duties in the 14 military service or an agency of the federal government shall be credited in the 15 counting of years of practice under (b)(2) of this section. 16 (d) A temporary license or certificate issued under this section is valid for 180 17 days and may be extended at the discretion of the department or applicable board for 18 another 180 days, on application of the holder of the temporary license or certificate. 19 (e) This section does not apply to the practice of law or the regulation of 20 attorneys under AS 08.08.
