00 CS FOR SENATE BILL NO. 234(FIN) 01 "An Act relating to the voting procedures of the Alcoholic Beverage Control Board; 02 allowing the Alcoholic Beverage Control Board to release information contained in the 03 statewide database of alcohol purchases and shipments to the person who purchased the 04 alcohol or to whom the alcohol was shipped; relating to the access of persons under 21 to 05 premises where alcoholic beverages are sold, served, or consumed; extending the 06 termination date of the Alcoholic Beverage Control Board; and providing for an 07 effective date." 08 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 09 * Section 1. AS 04.06.060 is amended to read: 10 Sec. 04.06.060. Quorum and majority. Three members of the board 11 constitute a quorum for the conduct of business, except that a majority of the whole 12 membership of the board must approve all applications for new licenses, and all 13 renewals, transfers, suspensions, and revocations of existing licenses. AS 04.06.095 is amended to read: 05 Sec. 04.06.095. Statewide database. The board, after consulting with package 06 store licensees, shall create and maintain a statewide database that contains a monthly 07 record of the alcohol purchased by, and shipped to, a person who resides in a 08 municipality or established village that has restricted the sale of alcoholic beverages 09 under AS 04.11.491(a)(1), (2), or (3) or (b)(1) or (2). Except as otherwise specifically 10 provided in this section, the information contained in the database is confidential and 11 is not subject to inspection or copying under AS 40.25.110 - 40.25.220. Information in 12 the database shall be purged one year after entry unless it is needed for criminal 13 investigation or prosecution. Information in the database is available only to 14 (1) a package store licensee, agent, or employee to consult before 15 shipping alcohol to a purchaser in a restricted area as provided in AS 04.11.150(g); 16 (2) a law enforcement officer; 17 (3) a probation or parole officer; and 18 (4) the board; and 19 (5) the person who is the subject of the information; the board 20 shall adopt regulations concerning access by a person to information contained in 21 the database of the purchases by, and shipments to, that person. 22 * Sec. 3. AS 44.66.010(a)(1) is amended to read: 23 (1) Alcoholic Beverage Control Board (AS 04.06.010) - June 30, 2011 24 [2010]; 25 * Sec. 4. AS 04.16.049(f) and 04.16.060(f) are repealed. 26 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
