01 "An Act relating to medical assistance coverage for traumatic brain injury services."                                   
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 47.07 is amended by adding a new section to read:                                                  
04            Sec. 47.07.046. Traumatic brain injury services. (a) The department shall                                  
05       provide traumatic brain injury services under a waiver in accordance with 42 U.S.C.                               
06       1396 - 1396p (Title XIX, Social Security Act), this chapter, and regulations adopted                              
07       under this chapter, if the department has received approval from the federal                                      
08       government and the department has appropriations allocated for the purpose. In                                    
09       addition to the annual assessment required in (b) of this section, the department shall                           
10       establish in regulation additional standards for eligibility and payment for the services.                        
11            (b)  Before the department may terminate payment for services provided under                                 
12       (a) of this section, the recipient must have had an annual assessment to determine                                
13       whether the recipient continues to meet the standards established by regulation under                             
14       (a) of this section.
