01 "An Act relating to retirement benefits for members of the Alaska Territorial Guard;                                    
02 and providing for an effective date."                                                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 26.10 is amended by adding a new section to read:                                                  
05              Article 3. Alaska Territorial Guard Retirement Benefits.                                                 
06            Sec. 26.10.100. Retirement benefits. (a) In addition to any other benefit for                              
07       which the individual is eligible, the department shall pay each month to an individual                            
08       who served for any period of time in the Alaska Territorial Guard a retirement benefit                            
09       of $550. The retirement benefit stops the month after the month in which the                                      
10       individual dies.                                                                                                  
11            (b)  To be eligible for the retirement benefit, an individual shall submit to the                            
12       department an application on a form established by the department and containing the                              
13       information that the department determines is necessary to determine whether the                                  
14       individual is eligible for the retirement benefit.                                                                

01            (c)  In this section,                                                                                        
02                 (1)  "department" means the Department of Military and Veterans'                                        
03       Affairs;                                                                                                          
04                 (2)  "retirement benefit" means the benefit described under (a) of this                                 
05       section.                                                                                                          
06    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
07 read:                                                                                                                   
08       RETROACTIVITY. AS 26.10.100, added by sec. 1 of this Act, is retroactive to                                       
09 February 1, 2009.                                                                                                       
10    * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
