00 HOUSE JOINT RESOLUTION NO. 35 01 Proposing amendments to the Constitution of the State of Alaska prohibiting passage of 02 laws that interfere with direct payments for health care services and the right to 03 purchase health care insurance from a privately owned company, and that compel a 04 person to participate in a health care system. 05 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. Article I, sec. 15, Constitution of the State of Alaska, is amended to read: 07 Section 15. Prohibited State Action. (a) No bill of attainder or ex post facto 08 law shall be passed. No law impairing the obligation of contracts, and no law making 09 any irrevocable grant of special privileges or immunities shall be passed. No 10 conviction shall work corruption of blood or forfeiture of estate. 11 * Sec. 2. Article I, sec. 15, Constitution of the State of Alaska, is amended by adding a new 12 subsection to read: 13 (b) No law shall be passed that prohibits a person from or that penalizes a 14 person for making direct payment to a health care provider for tendering health care 15 services, or that prohibits or penalizes the purchase of health care insurance from a

01 privately owned health care insurance company. Except for a health care system that 02 provides indemnity and medical benefits to injured workers, no law shall be passed 03 that compels a person, employer, or health care provider to participate in a health care 04 system or that penalizes a person, employer, or health care provider for declining to 05 participate in a health care system. 06 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 07 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 08 State of Alaska, and the election laws of the state.
