00 HOUSE BILL NO. 156 01 "An Act relating to municipal fees charged for disposal of waste material from the 02 substantial rehabilitation, renovation, demolition, removal, or replacement of a 03 structure on deteriorated property." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 29.10.200(29) is amended to read: 06 (29) AS 29.35.050(a) - (c) [AS 29.35.050] (garbage and solid waste 07 services); 08 * Sec. 2. AS 29.35.050(d) is amended to read: 09 (d) Subsections (a) - (c) of this [THIS] section apply [APPLIES] to home 10 rule and general law municipalities. 11 * Sec. 3. AS 29.35.050 is amended by adding a new subsection to read: 12 (e) A municipality that owns or operates a landfill or dumping area for the 13 disposal of waste material may, by ordinance, partially or totally exempt from a fee for 14 the use of the landfill or dumping area the disposal of waste material generated from
01 the substantial rehabilitation, renovation, demolition, removal or replacement of a 02 structure on deteriorated property. The exemption may apply to some or all types of 03 deteriorated property, as provided in the ordinance. An ordinance adopted under this 04 subsection must include specific eligibility requirements and require a written 05 application for the fee exemption. In this subsection, "deteriorated property" has the 06 meaning given in AS 29.45.050.
