00 HOUSE BILL NO. 155 01 "An Act relating to the authorization for the Department of Transportation and Public 02 Facilities to participate in the American Recovery and Reinvestment Act of 2009; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. The uncodified law of Alaska is amended by adding a section to read: 06 STATE PARTICIPATION IN THE AMERICAN RECOVERY AND 07 REINVESTMENT ACT OF 2009: INTENT AND AUTHORIZATION FOR THE 08 DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES. (a) It is the intent 09 of the legislature that the Department of Transportation and Public Facilities apply to the 10 following agencies of the United States Department of Homeland Security for funds available 11 to the state from the appropriations made in Division A, Title VI, P.L. 111-5 (American 12 Recovery and Reinvestment Act of 2009), and expend those funds, subject to appropriation: 13 (1) United States Customs and Border Protection; 14 (2) Transportation Security Administration;

01 (3) United States Coast Guard; 02 (4) Federal Emergency Management Agency. 03 (b) It is the intent of the legislature that the Department of Transportation and Public 04 Facilities apply to the following agencies of the United States Department of Transportation 05 for funds available to the state from the appropriations made in Division A, Title XII, P.L. 06 111-5 (American Recovery and Reinvestment Act of 2009), and expend those funds, subject 07 to appropriation: 08 (1) Office of the Secretary; 09 (2) Federal Aviation Administration; 10 (3) Federal Highway Administration; 11 (4) Federal Transit Administration; 12 (5) Maritime Administration. 13 (c) It is the intent of the legislature that the Department of Transportation and Public 14 Facilities seek to maximize the funding made available to the state, recognizing that the 15 United States Department of Transportation may have discretion in the manner in which the 16 United States Department of Transportation allocates funding under some or all of the 17 appropriations under Division A, Title XII, P.L. 111-5 (American Recovery and Reinvestment 18 Act of 2009). 19 (d) Notwithstanding any provision of state law, and to the extent not already 20 authorized by state law, the Department of Transportation and Public Facilities is authorized 21 to participate in the programs and funding enacted by Division A, Titles VI and XII, P.L. 22 111-5 (American Recovery and Reinvestment Act of 2009). 23 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
