00 CS FOR HOUSE BILL NO. 89(L&C) 01 "An Act repealing the Governor's Committee on Employment of People with 02 Disabilities; creating the State Vocational Rehabilitation Committee and relating to the 03 committee; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 23.15.220 is amended to read: 06 Sec. 23.15.220. Purpose. The purpose of AS 23.15.220 - 23.15.320 is to create 07 a State Vocational Rehabilitation Committee [GOVERNOR'S COMMITTEE ON 08 EMPLOYMENT OF PEOPLE WITH DISABILITIES] for Alaska to carry on a 09 continuing program to promote the employment of people of the state with disabilities 10 by creating statewide interest in the rehabilitation and employment of people with 11 disabilities, and by obtaining and maintaining cooperation with public and private 12 groups and individuals in this field. 13 * Sec. 2. AS 23.15.230 is amended to read: 14 Sec. 23.15.230. Appointment of committee. The governor shall appoint the
01 members of the State Vocational Rehabilitation Committee [GOVERNOR'S 02 COMMITTEE CONSISTS OF NOT MORE THAN 12 MEMBERS APPOINTED BY 03 THE GOVERNOR] for staggered terms not exceeding three years. The composition 04 of the committee must be consistent with the requirements of 29 U.S.C. 725 and 05 3003, as amended [THE COMMITTEE SHALL BE COMPOSED OF STATE 06 LEADERS OF INDUSTRY, BUSINESS, AGRICULTURE, LABOR, VETERANS, 07 WOMEN, RELIGIOUS, EDUCATIONAL, CIVIC, FRATERNAL, WELFARE, 08 SCIENTIFIC, MILITARY, MEDICAL, AND OTHER PROFESSIONS, OR AS 09 MANY OF THESE AND LIKE CATEGORIES AS MAY BE FEASIBLY 10 REPRESENTED]. A member may be reappointed, and a vacancy shall be filled by the 11 governor. 12 * Sec. 3. AS 23.15.240 is amended to read: 13 Sec. 23.15.240. Selection [APPOINTMENT] and term of chair. The 14 members of the committee shall select a member from among the voting 15 members of the committee to serve as chair, subject to disapproval by the 16 governor. The chair serves [GOVERNOR SHALL APPOINT A CHAIR OF THE 17 COMMITTEE WHO SERVES AS CHAIR] for one year or until a successor is 18 selected [APPOINTED]. 19 * Sec. 4. AS 23.15.260 is amended to read: 20 Sec. 23.15.260. Meetings. The committee shall meet four times a year 21 [ANNUALLY], but, at the request of the governor, special meetings may be called. 22 Meetings may be conducted telephonically. 23 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 24 read: 25 TRANSITION: MEMBERS OF THE GOVERNOR'S COMMITTEE ON 26 EMPLOYMENT OF PEOPLE WITH DISABILITIES. A member of the Governor's 27 Committee on Employment of People with Disabilities on the day before the effective date of 28 this Act continues to serve as a member of the State Vocational Rehabilitation Committee, 29 created by AS 23.15.220, as amended by sec. 1 of this Act, if the Department of Labor and 30 Workforce Development finds that the member meets the eligibility requirements under 31 AS 23.15.230, as amended by sec. 2 of this Act. A member who continues service under this
01 section after the effective date of this Act 02 (1) serves until the member's term would have expired as a member of the 03 Governor's Committee on Employment of People with Disabilities; and 04 (2) may apply to the governor for reappointment to the State Vocational 05 Rehabilitation Committee after the member's term expires. 06 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 07 read: 08 REVISOR'S INSTRUCTION. The revisor of statutes shall change the heading of art. 09 2 of AS 23.15 from "Governor's Committee on Employment of People with Disabilities" to 10 "State Vocational Rehabilitation Committee." 11 * Sec. 7. This Act takes effect immediately under AS 01.10.070(c).
