00 SENATE BILL NO. 294 01 "An Act relating to the pay and duties of commissioners of the Regulatory Commission 02 of Alaska, establishing the position of executive director of the Regulatory Commission 03 of Alaska and defining the duties and powers of the position, and placing the executive 04 director and administrative law judges of the Regulatory Commission of Alaska in the 05 exempt service under the State Personnel Act." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 39.25.110 is amended by adding a new paragraph to read: 08 (43) the executive director and administrative law judges of the 09 Regulatory Commission of Alaska. 10 * Sec. 2. AS 39.25.120(c)(18) is amended to read: 11 (18) hearing officers [AND ADMINISTRATIVE LAW JUDGES] of 12 the Regulatory Commission of Alaska; 13 * Sec. 3. AS 42.04.020(f) is amended to read:

01 (f) Members of the commission are in the exempt service and are entitled to a 02 monthly salary equal to Step F [C], Range 30 [26], of the salary schedule in 03 AS 39.27.011(a) for Juneau, Alaska. [THE CHAIR OF THE COMMISSION IS 04 ENTITLED TO A MONTHLY SALARY EQUAL TO STEP C, RANGE 27, OF THE 05 SALARY SCHEDULE IN AS 39.27.011(a) FOR JUNEAU, ALASKA.] 06 * Sec. 4. AS 42.04.050(a) is amended to read: 07 (a) The commission shall employ an executive director [CHAIR OF THE 08 COMMISSION IS] responsible for employing commission staff, directing the 09 administrative functions of the commission, and carrying out the commission's 10 policies, and shall determine the executive director's compensation [AS SET BY 11 THE COMMISSION]. The executive director [COMMISSION CHAIR] may employ 12 engineers, hearing examiners, [ADMINISTRATIVE LAW JUDGES,] arbitrators, 13 mediators, experts, clerks, accountants, and other agents and assistants considered 14 necessary. The executive director and administrative law judges of the 15 commission are in the exempt service under AS 39.25.110. Employees of the 16 commission who are not in the exempt service under AS 39.25.110 or the partially 17 exempt service under AS 39.25.120 are in the classified service under AS 39.25.100. 18 * Sec. 5. AS 42.04.050(b) is amended to read: 19 (b) The executive director [CHAIR OF THE COMMISSION] may enter into 20 a contract for not [NO] more than $5,000 to engage the services of a consultant or 21 expert the chair of the commission considers necessary. The executive director 22 [COMMISSION] may contract for and engage the services of consultants and experts 23 the commission considers necessary. 24 * Sec. 6. AS 42.04.070(a) is amended to read: 25 (a) The chair of the commission shall 26 [(1) EMPLOY THE COMMISSION STAFF; 27 (2)] establish and implement a time management system for the 28 commission and [; 29 (3)] assign the work of the commission to members and staff of the 30 commission so that matters before the commission are resolved as expeditiously and 31 competently as possible; when assigning a matter, the chair shall also set a date by
