00 SENATE BILL NO. 289 01 "An Act relating to home energy conservation and weatherization for purposes of 02 certain programs of the Alaska Housing and Finance Corporation." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.56.096(c) is amended to read: 05 (c) The corporation may not make, participate in the making of, purchase, or 06 participate in the purchase of a loan for a residential building if construction of the 07 building began after December 31, 1991, unless the building complies with the 08 thermal and lighting energy standards required by AS 46.11.040. The corporation 09 (1) may adopt regulations to implement this subsection; and 10 (2) shall, by regulation, establish 11 (A) procedures by which the person responsible for the 12 construction of the building may demonstrate that the building complies with 13 the thermal and lighting energy standards, including 14 (i) self-certification, if the contractor responsible for the
01 building construction provides satisfactory evidence that the contractor 02 has completed a training program that [OF THE ALASKA 03 CRAFTSMAN HOME PROGRAM OR EQUIVALENT TRAINING 04 PROGRAM AND THE TRAINING PROGRAM] is satisfactory to the 05 corporation; 06 (ii) submission of the certificate of a registered 07 architect, registered engineer, or a building inspector, and the architect, 08 engineer, or building inspector has completed a training program that 09 [OF THE ALASKA CRAFTSMAN HOME PROGRAM OR 10 EQUIVALENT TRAINING PROGRAM AND THE TRAINING 11 PROGRAM] is satisfactory to the corporation; 12 (iii) submission of the certificate of occupancy issued 13 by the municipality in which the building is located, if the certificate is 14 issued by a municipality in which the municipal building code meets or 15 exceeds the thermal and lighting energy standards, as determined by the 16 corporation; 17 (iv) another method approved by the corporation in 18 regulations adopted by the corporation; and 19 (B) criteria by which the energy conservation standards may be 20 met; for purposes of this subparagraph, the residential building complies with 21 the energy standards if the residence has received a rating under a home 22 energy rating system adopted by the corporation that [THE RATING 23 SYSTEM DEVELOPED BY ENERGY RATED HOMES OF ALASKA IF], 24 in the judgment of the corporation, [THE RATING] meets or exceeds the 25 thermal energy standards required by AS 46.11.040. 26 * Sec. 2. AS 18.56.410(c) is amended to read: 27 (c) The corporation shall adopt guidelines and procedures for the fund 28 [AFTER CONSULTATION WITH THE BOARD OF DIRECTORS OF THE 29 ALASKA CRAFTSMAN HOME PROGRAM]. 30 * Sec. 3. AS 18.56.850(a) is amended to read: 31 (a) The corporation shall plan, study, implement, and assist programs for
01 home energy conservation and weatherization including, without limitation, the 02 (1) [ALASKA CRAFTSMAN HOME PROGRAM; 03 (2) ENERGY RATED HOMES OF ALASKA PROGRAM; 04 (3)] home energy loan program; 05 (2) [(4)] rural capital retrofit program; and 06 (3) energy efficiency and [(5) LOW INCOME] weatherization 07 program.
