01 "An Act relating to liability for harm to children who are in the custody of the state."                                
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 47.10.960 is amended to read:                                                                      
04            Sec. 47.10.960. Civil liability. Except as provided in (b) of this section,                              
05       failure [FAILURE] to comply with a provision of this title does not constitute a basis                        
06       for civil liability for damages.                                                                                  
07    * Sec. 2. AS 47.10.960 is amended by adding a new subsection to read:                                              
08            (b)  The state is not immune from liability for a negligent act of a state                                   
09       employee who is acting in the employee's official capacity under this title if the act                            
10       results in injury to or death of a child who is in the custody of the state.
