00 HOUSE CS FOR SENATE BILL NO. 211(JUD) 01 "An Act relating to an aggravating factor at sentencing concerning the knowledge of the 02 defendant regarding the vulnerability or incapability of resistance of the victim due to 03 homelessness." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 12.55.155(c)(5) is amended to read: 06 (5) the defendant knew or reasonably should have known that the 07 victim of the offense was particularly vulnerable or incapable of resistance due to 08 advanced age, disability, ill health, homelessness, or extreme youth or was for any 09 other reason substantially incapable of exercising normal physical or mental powers of 10 resistance; 11 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 12 read: 13 APPLICABILITY. This Act applies to offenses committed on or after the effective 14 date of this Act.
