01 "An Act relating to appropriations to the budget reserve fund."                                                         
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 37.10 is amended by adding a new section to read:                                                  
04            Sec. 37.10.440. Appropriations to the budget reserve fund of production                                    
05       tax revenue. (a) By February 1 of each year, the Department of Revenue shall                                    
06       determine whether the state received for the general fund, during the immediately                                 
07       preceding calendar year, an amount of money under AS 43.55.011(g) for any tax year.                               
08       If the state received an amount under AS 43.55.011(g), the department shall notify the                            
09       legislature of that amount.                                                                                       
10            (b)  The legislature may appropriate 50 percent of the amount identified by the                              
11       Department of Revenue under (a) of this section to the budget reserve fund (art. IX,                              
12       sec. 17, Constitution of the State of Alaska).                                                                    
13            (c)  Nothing in this section requires that money be appropriated or creates a                                
14       dedicated fund.
