00 SENATE BILL NO. 197 01 "An Act requiring credit card issuers to recognize certain dates as dates of payment." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 45.45 is amended by adding a new section to read: 04 Sec. 45.45.940. Date of payment. Unless otherwise required by federal law 05 and notwithstanding any other provision of law to the contrary, when a person who 06 uses a credit card makes a payment on the credit card account by 07 (1) mail, the issuer of the credit card may not use a date later than the 08 postmark date on the mailed payment as the date when the issuer considers that the 09 payment was made; 10 (2) computer, the issuer of the credit card may not use a date later than 11 the date the person completes the payment on the computer as the date when the issuer 12 considers that the payment was made; 13 (3) telephone, the issuer of the credit card may not use a date later than 14 the date the person completes the payment on the telephone as the date when the issuer 15 considers that the payment was made.

01 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 02 read: 03 APPLICABILITY. AS 45.45.940, added by sec. 1 of this Act, does not apply to a 04 contract for the issuance of a credit card that is entered into before the effective date of this 05 Act if the contract contains a provision that conflicts with AS 45.45.940.
