00 SENATE BILL NO. 169 01 "An Act relating to children engaging in inappropriate sexual conduct." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 47.10.011 is amended by adding a new paragraph to read: 04 (13) the child has engaged in inappropriate sexual conduct and the 05 child has not received appropriate treatment or supervision to protect the child or 06 others; in this paragraph, "inappropriate sexual conduct" has the meaning given in 07 AS 47.10.401. 08 * Sec. 2. AS 47.10 is amended by adding a new section to read: 09 Article 3A. Reporting of Children Engaging in Inappropriate Sexual Conduct. 10 Sec. 47.10.401. Duty to report children engaging in inappropriate sexual 11 conduct; investigation; penalty. (a) A parent or guardian or other person responsible 12 for a child or a person required to report abuse or neglect under AS 47.17.020 shall 13 immediately report to the department if the person witnesses or otherwise has 14 reasonable cause to believe that the child has engaged in inappropriate sexual conduct 15 with another child.

01 (b) The department shall open a case file for a child reported under this 02 section. The department may investigate and may take action as it determines 03 appropriate to protect the child and other children. 04 (c) In this section, "inappropriate sexual conduct" means conduct that would 05 be punishable as a felony under AS 11.41.410 - 11.41.470 if an adult were engaging in 06 the conduct with a child. 07 (d) A person who fails to report as required by (a) of this section commits a 08 class A misdemeanor and may be punished as provided in AS 12.55.
