01 "An Act modifying the criteria used to limit liability for certain airfield owners or                                   
02 operators."                                                                                                             
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 09.65.093(b) is amended to read:                                                                  
05            (b)  A person who is the owner or operator of an aircraft runway, airfield, or                               
06       landing area is not civilly liable, except for an act or omission that constitutes gross                          
07       negligence or recklessness or intentional misconduct, for the injury to or the death of a                         
08       person or for damage to an aircraft, resulting from the use or attempted use of the                               
09       runway, airfield, or landing area to take off, land, park, or operate an aircraft while the                       
10       runway, airfield, or landing area is                                                                              
11                 [(1)  MARKED AS CLOSED BY PLACEMENT OF A LARGE "X"                                                      
12       ON THE RUNWAY, IN ACCORDANCE WITH FEDERAL AVIATION                                                                
13       ADMINISTRATION GUIDELINES; AND                                                                                    
14                 (2)]  listed or charted, and designated as private [CLOSED] in the                                  

01       appropriate aeronautical charts and publications published by the Federal Aviation                                
02       Administration.
