00 SENATE BILL NO. 30 01 "An Act relating to failure to report certain crimes." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 11.56.765(a) is amended to read: 04 (a) A person, other than the victim, commits the crime of failure to report a 05 felony [VIOLENT CRIME COMMITTED AGAINST A CHILD] if the person 06 (1) witnesses what the person knows or reasonably should know is a 07 felony; 08 [(A) THE MURDER OR ATTEMPTED MURDER OF A 09 CHILD BY ANOTHER; 10 (B) THE KIDNAPPING OR ATTEMPTED KIDNAPPING 11 OF A CHILD BY ANOTHER; 12 (C) THE SEXUAL PENETRATION OR ATTEMPTED 13 SEXUAL PENETRATION BY ANOTHER 14 (i) OF A CHILD WITHOUT CONSENT OF THE 15 CHILD;

01 (ii) OF A CHILD THAT IS MENTALLY 02 INCAPABLE; 03 (iii) OF A CHILD THAT IS INCAPACITATED; OR 04 (iv) OF A CHILD THAT IS UNAWARE THAT A 05 SEXUAL ACT IS BEING COMMITTED; OR 06 (D) THE ASSAULT OF A CHILD BY ANOTHER CAUSING 07 SERIOUS PHYSICAL INJURY TO THE CHILD; 08 (2) KNOWS OR REASONABLY SHOULD KNOW THAT THE 09 CHILD IS UNDER 16 YEARS OF AGE;] and 10 (2) [(3)] does not in a timely manner report that crime to a peace 11 officer or law enforcement agency. 12 * Sec. 2. AS 11.56.765(d) is amended to read: 13 (d) Failure to report a felony [VIOLENT CRIME COMMITTED AGAINST 14 A CHILD] is a class C felony [A MISDEMEANOR]. 15 * Sec. 3. AS 11.56.765(c) is repealed. 16 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 17 read: 18 APPLICABILITY. This Act applies to offenses committed on or after the effective 19 date of this Act.
