00 HOUSE JOINT RESOLUTION NO. 26 01 Proposing an amendment to the Constitution of the State of Alaska relating to direction 02 and control of the medical care and treatment of minors. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article I, Constitution of the State of Alaska, is amended by adding a new 05 section to read: 06 Section 26. Parental and Guardian Direction and Control of Medical Care 07 and Treatment of Minors. Notwithstanding any other provision of this constitution, a 08 parent or guardian has the right to direct and control the medical care and treatment of 09 the parent's or guardian's minor child, subject only to emergency exceptions and a 10 judicial bypass procedure. The exceptions and judicial bypass procedure shall be 11 narrowly tailored to protect the rights and health of the minor child and be consistent 12 with standards established by the United States Supreme Court. 13 * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of the 14 state at the next general election in conformity with art. XIII, sec. 1, Constitution of the State 15 of Alaska, and the election laws of the state.
