00                 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 387                                                              
01 "An Act limiting the number of published telephone directories that may be distributed                                  
02 to a household."                                                                                                        
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 42.05 is amended by adding a new section to read:                                                  
05            Sec. 42.05.298. Limitation on published telephone directory distribution.                                  
06       Unless otherwise requested by a member of the household, a telephone utility may                                  
07       distribute only one published telephone directory to a household each year.                                       
08    * Sec. 2. AS 42.05.711(e) is amended to read:                                                                      
09            (e)  Notwithstanding any other provisions of this chapter, any electric or                                   
10       telephone utility that does not gross $50,000 annually is exempt from regulation under                            
11       this chapter, except the limitation described in AS 42.05.298, unless the subscribers                         
12       petition the commission for regulation under AS 42.05.712(h).                                                     
13    * Sec. 3. AS 42.05.711(f) is amended to read:                                                                      
14            (f)  Notwithstanding any other provisions of this chapter, an electric or                                    

01       telephone utility that does not gross $500,000 annually may elect to be exempt from                               
02       the provisions of this chapter other than AS 42.05.221 - 42.05.281 and, for a                                 
03       telephone utility, other than the limitation described in AS 42.05.298, under the                             
04       procedure described in AS 42.05.712.                                                                              
05    * Sec. 4. AS 45.50.475 is amended by adding a new subsection to read:                                              
06            (h)  Unless otherwise requested by a member of the household, a company that                                 
07       publishes, distributes, or otherwise provides a telephone directory may distribute only                           
08       one published telephone directory to a household each year.
