01 "An Act prohibiting a municipality from requiring a dedication of property for                                          
02 recreational purposes in platting requirements or as a condition of plat approval."                                     
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 29.35.180(b)  is amended to read:                                                                  
05            (b)  A home rule borough shall provide for planning, platting, and land use                                  
06       regulation. A unified municipality or other home rule borough may not require                                 
07       the dedication of property for a recreational facility, recreational project, or                              
08       other recreational purpose in platting requirements or as a condition of plat                                 
09       approval.                                                                                                     
10    * Sec. 2. AS 29.40.070 is amended by adding a new subsection to read:                                              
11            (b)  A municipality may not require the dedication of property for a                                         
12       recreational facility, recreational project, or other recreational purpose in platting                            
13       requirements or as a condition of plat approval.
