00 SENATE CS FOR CS FOR HOUSE BILL NO. 305(STA) 01 "An Act relating to campaign fund raising during a regular or special legislative session; 02 and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 15.13.072(d) is repealed and reenacted to read: 05 (d) While the legislature is convened in a regular or special legislative session, 06 a legislator may not solicit or accept a contribution to be used for the purpose of 07 influencing the outcome of an election under this chapter unless 08 (1) it is an election in which the legislator is a candidate and the 09 contribution is for that legislator's campaign; 10 (2) the solicitation or acceptance occurs during the 90 days 11 immediately preceding that election; and 12 (3) the solicitation or acceptance occurs in a place other than the 13 capital city or a municipality in which the legislature is convened in special session if 14 the legislature is convened in a municipality other than the capital city.

AS 24.60.031(a) is amended to read: 02 (a) A [LEGISLATOR OR] legislative employee may not 03 (1) on a day when either house of the legislature is in regular or special 04 session, solicit or accept a contribution or a promise or pledge to make a contribution 05 for a campaign for state or municipal office [THE STATE LEGISLATURE]; 06 however, a [LEGISLATOR OR] legislative employee may, except in the capital city 07 or in the municipality in which the legislature is convened in special session if the 08 legislature is convened in a municipality other than the capital city, solicit or 09 accept a contribution, promise, or pledge for a campaign for state or municipal office 10 [THE STATE LEGISLATURE] that occurs during the 90 days immediately preceding 11 the [AN] election for that office; or 12 (2) accept money from an event held on a day when either house of the 13 legislature is in regular or special session if a substantial purpose of the event is to 14 raise money on behalf of the [MEMBER OR] legislative employee for [STATE 15 LEGISLATIVE] political purposes; however, this paragraph does not prohibit a 16 [LEGISLATOR OR] legislative employee from accepting money from an event held 17 in a place other than the capital city or a municipality in which the legislature is 18 convened in special session if the legislature is convened in a municipality other 19 than the capital city during the 90 days immediately preceding an election for state 20 or municipal public office in which the legislative employee is a candidate [; OR 21 (3) IN A CAMPAIGN FOR THE STATE LEGISLATURE, EXPEND 22 MONEY THAT WAS RAISED ON A DAY WHEN EITHER HOUSE OF THE 23 LEGISLATURE WAS IN A LEGISLATIVE SESSION BY OR ON BEHALF OF A 24 LEGISLATOR UNDER A DECLARATION OF CANDIDACY OR A GENERAL 25 LETTER OF INTENT TO BECOME A CANDIDATE FOR PUBLIC OFFICE; 26 HOWEVER, THIS PARAGRAPH DOES NOT APPLY TO MONEY RAISED IN A 27 PLACE OTHER THAN THE CAPITAL CITY DURING THE 90 DAYS 28 IMMEDIATELY PRECEDING AN ELECTION]. 29 * Sec. 3. AS 24.60.031 is amended by adding a new subsection to read: 30 (c) A legislator may not 31 (1) on a day when either house of the legislature is in regular or special

01 session, solicit or accept a contribution or a promise or pledge to make a contribution 02 (A) for the legislator's own campaign for state or municipal 03 public office, unless the solicitation, acceptance, promise, or pledge occurs in a 04 place other than the capital city or a municipality in which the legislature is 05 convened in special session if the legislature is convened in a municipality 06 other than the capital city during the 90 days immediately preceding the 07 election in which the legislator is a candidate; 08 (B) for another candidate in an election for municipal, state, or 09 federal office; 10 (C) to influence a state ballot proposition or question; or 11 (D) for a political party; 12 (2) accept money from an event held on a day when either house of the 13 legislature is in regular or special session if a substantial purpose of the event is to 14 raise money on behalf of the legislator's campaign for state or municipal public office; 15 however, this paragraph does not prohibit a legislator from accepting money from an 16 event held in a place other than the capital city or a municipality in which the 17 legislature is convened in special session if the legislature is convened in a 18 municipality other than the capital city during the 90 days immediately preceding a 19 state or municipal election in which the legislator is a candidate; or 20 (3) in a campaign for state or municipal office, expend money that was 21 raised on a day when either house of the legislature was in a legislative session by or 22 on behalf of a legislator under a declaration of candidacy or a general letter of intent to 23 become a candidate for public office; however, this paragraph does not apply to 24 money raised in a place other than the capital city or a municipality in which the 25 legislature is convened in special session if the legislature is convened in a 26 municipality other than the capital city during the 90 days immediately preceding an 27 election in which the legislator is a candidate. 28 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
