00 HOUSE BILL NO. 302 01 "An Act relating to the public's right to know certain information relating to water 02 pollution, and requiring the Department of Environmental Conservation to collect and 03 make available that information to the public." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 06 to read: 07 LEGISLATIVE INTENT. (a) It is the intent of the legislature that this Act ensure that 08 the people of Alaska have the right to know the amount and nature of pollutants, 09 contaminants, and waste discharged under permit into Alaska waters. 10 (b) It is the intent of the legislature that this Act does not apply to permits issued for 11 streambed disturbance, water turbidity, and private sewer systems. 12 * Sec. 2. AS 46.03 is amended by adding a new section to read: 13 Sec. 46.03.026. Information to be collected and made available by the 14 department. (a) The department shall require an annual report from a person for

01 whom the department authorizes a mixing zone under AS 46.03.100 - 46.03.120. 02 (b) The report required under (a) of this section must be in a form prescribed 03 by the department and contain 04 (1) the amount, nature, and description of the pollutant, contaminant, 05 or waste; 06 (2) the location, type, and duration of the permitted activity; and 07 (3) other information the department may require. 08 (c) The department shall annually compile information collected under this 09 section and make the information reported under (b) of this section available to the 10 public on the department's Internet website. 11 (d) This section does not apply to information about streambed disturbance or 12 water turbidity levels, or private sewage systems. 13 (e) In this section, "mixing zone" means a volume of water adjacent to a 14 discharge in which discharged waste mixes with the receiving water.
