00 HOUSE BILL NO. 244 01 "An Act creating an Alaska Medal of Honor and establishing criteria for awarding the 02 medal." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 26.05.190 is amended by adding a new subsection to read: 05 (e) The adjutant general shall maintain the Alaska Medal of Honor Roll. 06 * Sec. 2. AS 26.05 is amended by adding a new section to read: 07 Sec. 26.05.342. Alaska Medal of Honor. (a) There is created an Alaska Medal 08 of Honor. The Alaska Medal of Honor may be awarded to an individual who has been 09 killed in action while 10 (1) engaged in an action against any enemy of the United States; 11 (2) engaged in military operations involving conflict with an opposing 12 foreign force; 13 (3) serving with friendly foreign forces engaged in an armed conflict 14 against an opposing armed force in which the United States is not a belligerent party;

01 or 02 (4) serving in or deploying to or from a combat zone as designated by 03 presidential order. 04 (b) To be eligible to receive the Alaska Medal of Honor, an individual must 05 have been, at the time the individual was killed in action, a member of 06 (1) the Alaska National Guard who was a legal resident of the state; 07 (2) the United States military reserves who was a legal resident of the 08 state; or 09 (3) the regular United States armed forces who was 10 (A) a legal resident of the state; or 11 (B) stationed in the state by a proper order of the United States 12 Department of Defense. 13 (c) The Alaska Medal of Honor shall be awarded by a concurrent resolution 14 drafted in consultation with the adjutant general's office. The resolution must be 15 (1) introduced by the president of the senate, the speaker of the house 16 of representatives, a member of the legislature who is the authorized representative of 17 the president of the senate or the speaker of the house of representatives, or the chair 18 of the committee of each house of the legislature with primary jurisdiction over 19 military and veterans' affairs; and 20 (2) adopted by both houses of the legislature. 21 (d) The Joint Armed Services Committee shall make arrangements for the 22 designing and awarding of the Alaska Medal of Honor. 23 (e) The adjutant general shall enter the name of each recipient of the Alaska 24 Medal of Honor on the Alaska Medal of Honor Roll maintained under 25 AS 26.05.190(e).
