00 HOUSE BILL NO. 211 01 "An Act imposing a fee on homeowner's insurance policies issued or renewed in the 02 state; requiring an insurer issuing or renewing a homeowner's insurance policy to 03 collect the fee; and creating a special account in the general fund, allowing money in the 04 fund to be appropriated to the Department of Public Safety for the Alaska Fire 05 Standards Council, and repealing the Alaska fire services personnel fund." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 21.09.210 is amended by adding a new subsection to read: 08 (q) Notwithstanding (e) of this section, a fee of $3 is imposed on each 09 homeowner's insurance policy issued or renewed in this state. An insurer issuing or 10 renewing a homeowner's insurance policy shall collect the fee from the policy holder 11 for each homeowner policy issued. The insurer shall pay the money collected to the 12 director quarterly on a date specified by the director with a report of the number of 13 homeowner's policies issued. The director shall deposit the money collected under this
01 subsection in the Alaska Fire Standards Council fund, a special account in the general 02 fund, established under AS 37.05.585. In this subsection, "homeowner's insurance 03 policy" means a package policy combining property coverage for personal property or 04 a structure or both, and personal liability coverage, and may include a dwelling, an 05 appurtenant structure, unscheduled personal property, and a mobile home at a fixed 06 location. 07 * Sec. 2. AS 37.05 is amended by adding a new section to article 7 to read: 08 Sec. 37.05.585. Alaska Fire Standards Council fund. (a) There is established 09 as a special account in the general fund the Alaska Fire Standards Council fund 10 consisting of money deposited to the fund under AS 21.09.210(q) and appropriations 11 to the fund. Income earned on money in the fund may be appropriated to the fund. 12 (b) Money may be appropriated from the fund to the Department of Public 13 Safety for the Alaska Fire Standards Council (AS 18.70.330) or for other public 14 purposes. 15 (c) Nothing in this section creates a dedicated fund. 16 * Sec. 3. AS 18.70.360 is repealed.
