00 HOUSE BILL NO. 193 01 "An Act relating to the composition of the Alaska Police Standards Council; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.65.150 is amended to read: 05 Sec. 18.65.150. Composition of council. The council consists of the following 06 persons: 07 (1) three [FOUR] chief administrative officers or chiefs of police of 08 local governments, except that, in lieu of one of these officers or chiefs of police, 09 the governor may appoint a correctional administrative officer who is employed 10 at the level of a deputy director or higher; 11 (2) the commissioner of public safety or a designee of the 12 commissioner; 13 (3) the commissioner of corrections or a designee of the commissioner; 14 (4) three police officers, each of whom has been certified for five

01 years or more by the council under this chapter [ONE CORRECTIONAL 02 ADMINISTRATIVE OFFICER WHO IS EMPLOYED AT THE LEVEL OF A 03 DEPUTY DIRECTOR OR HIGHER]; and 04 (5) three [FOUR] members of the public at large with at least two 05 from [THE] communities of 2,500 population or less. 06 * Sec. 2. AS 18.65.160 is amended by adding new subsections to read: 07 (b) When making appointments of police officer members of the council 08 under (a) of this section, the governor may consider police officers who have been 09 nominated by labor organizations that represent public safety employees. Each 10 organization may nominate not more than 10 police officers. 11 (c) In this section, "labor organization" means a labor organization as defined 12 under AS 23.40.030 that is registered with the Department of Labor and Workforce 13 Development. 14 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 15 read: 16 TRANSITIONAL PROVISIONS. The terms of the members of the Alaska Police 17 Standards Council who are serving on the effective date of this Act are not affected by this 18 Act and expire as provided before the enactment of this Act. The first vacancy created by the 19 resignation, removal, or conclusion of a term of a correctional administrative officer shall be 20 filled by a police officer appointed under AS 18.65.150(a)(4), as amended by sec. 1 of this 21 Act. The first vacancy created by the resignation, removal, or conclusion of a term of a chief 22 administrative officer or chief of police of a local government shall be filled by a police 23 officer appointed under AS 18.65.150(a)(4), as amended by sec. 1 of this Act. The first 24 vacancy created by the resignation, removal, or conclusion of a term of a public member shall 25 be filled by a police officer appointed under AS 18.65.150(a)(4), as amended by sec. 1 of this 26 Act. If these vacancies occur concurrently or within a period of less than three years, the 27 police officer members appointed under sec. 1 of this Act may be appointed to terms of less 28 than four years, so that the police officer members serve staggered terms. 29 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
