01 "An Act relating to the amount and payment of the state business license fee and to a                                   
02 civil fine for not having a current business license; and providing for an effective date."                             
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 43.70.020 is amended by adding a new subsection to read:                                           
05            (e)  If a person knowingly engages in a business in the state without having a                               
06       current license issued under (a) of this section, the department may impose a civil fine                          
07       of up to $100. In this subsection, "knowingly" has the meaning given in AS 11.81.900.                             
08    * Sec. 2. AS 43.70.030(a) is amended to read:                                                                      
09            (a)  The fee for each business license is $50 a [$100 PER] year [, EXCEPT                                
10       THAT THE FEE IS $50 IF                                                                                            
11                 (1)  THE BUSINESS IS A SOLE PROPRIETORSHIP; AND                                                         
12                 (2)  THE SOLE PROPRIETOR IS 65 YEARS OF AGE OR OLDER                                                    
13       WHEN THE SOLE PROPRIETOR APPLIES FOR THE LICENSE OR WILL                                                          
14       REACH 65 YEARS OF AGE AT ANY TIME DURING THE YEAR FOR WHICH                                                       

01       THE LICENSE IS ISSUED].                                                                                           
02    * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to                          
03 read:                                                                                                                   
04       TRANSITIONAL PROVISIONS: APPLICABILITY AND APPORTIONMENT OF                                                       
05 FEE CHANGE. (a) The annual fee for a business license that is paid in 2007 before July 1,                               
06 2007 is the rate established under AS 43.70.030(a), as that subsection exists before being                              
07 amended by sec. 2 of this Act.                                                                                          
08       (b)  Notwithstanding AS 43.70.030(a), as amended by sec. 2 of this Act or as that                                 
09 section exists before being amended by sec. 2 of this Act, a person who obtains a business                              
10 license under AS 43.70.020(a) on or after January 1, 2007, but before January 1, 2009, shall                            
11 pay a fee for the license that is apportioned to reflect the period of the license when the fee                         
12 amount for the license is subject to AS 43.70.030(a), as that subsection exists before July 1,                          
13 2007, and the period of the license when the fee amount for the license is subject to                                   
14 AS 43.70.030(a), as that subsection is amended by sec. 2 of this Act.                                                   
15    * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to                          
16 read:                                                                                                                   
17       TRANSITIONAL PROVISION: REGULATIONS. The Department of Commerce,                                                  
18 Community, and Economic Development shall adopt regulations necessary to implement the                                  
19 changes made by this Act, including the apportionment of license fees under sec. 3 of this                              
20 Act. The regulations take effect under AS 44.62 (Administrative Procedure Act), but not                                 
21 before July 1, 2007.                                                                                                    
22    * Sec. 5. Section 4 of this Act takes effect immediately under AS 01.10.070(c).                                    
23    * Sec. 6. Except as provided in sec. 5 of this Act, this Act takes effect July 1, 2007.
