00 CS FOR HOUSE BILL NO. 69(JUD) 01 "An Act relating to executive clemency." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 33.20.080(a) is amended to read: 04 (a) The governor shall [MAY] refer applications for executive clemency to 05 the board of parole and may not act on an application, except to deny an 06 application, unless 180 days have elapsed since the notice required under (b) of 07 this section has been provided. The board shall investigate each case and, not later 08 than 180 days after receipt of the application, submit to the governor a report of the 09 investigation, together with all other information the board has regarding the applicant. 10 When the report or investigation is submitted, the board shall also transmit to the 11 governor the comments it has received under (b) of this section. 12 * Sec. 2. AS 33.20.080(b) is amended to read: 13 (b) The board shall send notice of an application for executive clemency 14 to the Department of Law, the office of victims' rights, and [IF REQUESTED BY] 15 the victim of a crime against a person, a crime involving domestic violence, or arson

01 in the first degree within five business days after receipt of the application [, THE 02 BOARD SHALL SEND NOTICE OF AN APPLICATION FOR EXECUTIVE 03 CLEMENCY SUBMITTED BY THE STATE PRISONER WHO WAS 04 CONVICTED OF THAT CRIME]. The victim may comment in writing to the board 05 on the application for executive clemency. The board shall provide notice of any 06 action taken by the governor on an application for executive clemency to the 07 Department of Law, the office of victims' rights, and the victim.
