00 HOUSE BILL NO. 47 01 "An Act creating the line-of-duty death survivor education benefits fund and relating to 02 special fire fighter and emergency medical service provider license plates." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.43.085 is amended by adding a new subsection to read: 05 (c) The line-of-duty death survivor education benefits fund is created in the 06 general fund. The fund consists of appropriations to the fund, income earned by 07 investment of the money in the fund, and gifts and donations to the fund. 08 Appropriations to the fund do not lapse. The fund may be further divided to provide 09 separate accounts for benefits for peace officers, fire fighters, and members of the 10 armed services. The fund may be used to provide free tuition and fees as provided in 11 (a) of this section. Nothing in this section creates a dedicated fund. 12 * Sec. 2. AS 28.10.181 is amended by adding a new subsection to read: 13 (x) Special request active fire fighter and emergency medical service provider 14 plates, former fire fighter and emergency medical service provider plates, and plates
01 commemorating fire fighters and emergency medical service providers. On application 02 by the owner of a motor vehicle, the department may issue registration plates for 03 active fire fighters and emergency medical service providers, registration plates for 04 former fire fighters and emergency medical service providers, and registration plates 05 commemorating fire fighters and emergency medical service providers. The 06 commissioner shall determine the design and color of the plates. The department may 07 disapprove the issuance of registration plates under this subsection when the requested 08 plates are a duplication of an existing registration. To be eligible for 09 (1) an active fire fighter and emergency medical service provider plate, 10 a person must present satisfactory proof that the person is an active member of 11 (A) a fire department in this state and the fire department is 12 recognized as a fire department by the state fire marshal; or 13 (B) an out-of-hospital emergency medical service certified by 14 the Department of Health and Social Services; 15 (2) a former fire fighter and emergency medical service provider plate 16 a person must present satisfactory proof that the person was an active member of 17 (A) a fire department in this state for a minimum of 10 years; 18 or 19 (B) an out-of-hospital emergency medical service certified by 20 the Department of Health and Social Services for a minimum of 10 years. 21 * Sec. 3. AS 28.10.421(d) is amended by adding a new paragraph to read: 22 (17) special request plates 23 (A) for active fire fighter and emergency medical service 24 provider..................................................................................................... 25 (B) for former fire fighter and emergency medical service 26 provider..................................................................................................... 27 (C) commemorating fire fighters and emergency medical 28 service providers.........................................................................................$10 29 plus a fee of $35 and the fee required for that vehicle under (b), (c), (h), or (i) of this 30 section; the fee required by (A) - (C) of this paragraph shall be collected only on the 31 first issuance of and the replacement of the plates; the $35 fee required by this
01 paragraph shall be collected biennially in the same manner as the fee required under 02 (b), (c), (h), or (i) of this section; the commissioner of administration shall separately 03 account for the fees received under this paragraph that the department deposits in the 04 general fund; notwithstanding (g) of this section, the annual estimated balance in the 05 account that is in excess of the cost of issuing special request plates may be 06 appropriated by the legislature for the purposes provided in AS 14.43.085.
