00 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 36 01 "An Act relating to the authority of registered nurses to assist in the training of persons 02 who seek to become emergency medical technicians or mobile intensive care 03 paramedics." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.68 is amended by adding a new section to article 6 to read: 06 Sec. 08.68.397. Training of emergency personnel. The board shall adopt 07 regulations under which a licensed registered nurse may train a person to perform 08 invasive procedures and administer medications if 09 (1) the nurse has received additional training approved by the board in 10 how to train other persons to perform invasive procedures or administer medications; 11 (2) the person being trained by the nurse is in a course of training 12 approved by the State Medical Board to become a registered mobile intensive care 13 paramedic under AS 08.64.107 or in a course of training approved by the Department 14 of Health and Social Services to become an emergency medical technician under

01 AS 18.08; 02 (3) the invasive procedures and administration of medication are 03 within the nurse's scope of licensure; and 04 (4) the invasive procedures and administration of medication are 05 within the scope of activities that may be authorized for the trainee after the trainee is 06 registered as a mobile intensive care paramedic under AS 08.64.107 or certified as an 07 emergency medical technician under AS 18.08. 08 * Sec. 2. AS 08.68.400(a) is amended to read: 09 (a) This chapter does not apply to 10 (1) a qualified nurse licensed in another state employed by the United 11 States Government or a bureau, or agency, or division of the United States 12 Government while in the discharge of official duties; 13 (2) nursing service given temporarily in the event of a public 14 emergency, epidemic, or disaster; 15 (3) the practice of nursing by a student enrolled in a nursing education 16 program accredited by the board when the practice is in connection with the student's 17 course of study; 18 (4) the practice of nursing by an individual who is in a course of 19 study approved by the State Medical Board for registration as a mobile intensive 20 care paramedic or who is in a course of study approved by the Department of 21 Health and Social Services for certification as an emergency medical technician 22 while the individual is being trained by a registered nurse authorized to provide 23 the training under AS 08.68.397; 24 (5) the practice of nursing by an individual enrolled in an approved 25 program or course of study approved by the board to satisfy the requirements of 26 AS 08.68.251; 27 (6) [(5)] the practice of nursing by a nurse licensed in another state 28 who engages in nursing education or nursing consultation activities, if these activities 29 and contact with clients do not exceed 20 working days within a licensing period; or 30 (7) [(6)] the practice of nursing by a nurse licensed in another state 31 whose employment responsibilities include transporting patients into, out of, or

01 through this state; however, this exception is valid for a period not to exceed 48 hours 02 for each transport. 03 * Sec. 3. AS 18.08.082 is amended by adding a new subsection to read: 04 (c) The regulations adopted under (a) of this section that set the minimum 05 standards for a training course for a person who seeks certification as an emergency 06 medical technician must include a provision that allows a nurse to assist in the training 07 if 08 (1) the nurse is licensed as a registered nurse under AS 08.68; 09 (2) the training activity performed by the nurse is for a procedure that 10 is within the scope of the nurse's licensure; and 11 (3) the nurse has received the additional training required by 12 regulations adopted by the Board of Nursing under AS 08.68.397.
