01 "An Act relating to business license applications and to the distribution of certain                                    
02 business license information by public agencies of the state."                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 40.25 is amended by adding a new section to read:                                                  
05            Sec. 40.25.160. Business license contact information. (a) When a public                                    
06       agency provides bulk information on business license holders to a member of the                                   
07       public under AS 40.25.110 - 40.25.220, the public agency may not include the contact                              
08       information provided by a licensee under AS 43.70.020 unless the licensee approves                                
09       the inclusion in writing.                                                                                         
10            (b)  In this section,                                                                                        
11                 (1)  "bulk information" means information on more than one licensee;                                    
12                 (2)  "business license" means a license issued under AS 43.70.020;                                      
13                 (3)  "contact information" means a telephone number or an address,                                      
14       including an electronic address;                                                                                

01                 (4)  "licensee" means a person who holds a business license;                                            
02                 (5)  "public agency" does not include a municipality, or a department,                                  
03       an institution, a board, a commission, a division, an authority, a public corporation, a                          
04       council, a committee, or another instrumentality of a municipality.                                               
05    * Sec. 2. AS 43.70.020 is amended by adding a new subsection to read:                                              
06            (e)  The application of a person for a license under this section must include a                             
07       statement signed by the person indicating whether the person consents to the release of                           
08       the person's contact information under AS 40.25.160.                                                              
09    * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to                          
10 read:                                                                                                                   
11       APPLICABILITY. AS 40.25.160 and AS 43.70.020(e), added by secs. 1 and 2 of this                                   
12 Act, apply only to a license issued or renewed under AS 43.70.020 on or after the effective                             
13 date of this Act.
