00 SENATE BILL NO. 177 01 "An Act eliminating the requirement that persons using titles or descriptions of services 02 that incorporate the terms 'psychotherapy,' 'psychotherapeutic,' or 'psychotherapist' be 03 licensed by the Board of Psychologist and Psychological Associate Examiners." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.86.180(a) is amended to read: 06 (a) Unless licensed under this chapter, a person may not practice psychology 07 or hold out publicly as a psychologist or as practicing psychology. A person holds out 08 as a psychologist by using a title or description of services incorporating the words 09 "psychology," "psychological," "psychologist," "psychometry," 10 ["PSYCHOTHERAPY," "PSYCHOTHERAPEUTIC," "PSYCHOTHERAPIST,"] 11 "psychoanalysis," or "psychoanalyst" or when holding out publicly to be trained, 12 experienced, or qualified to render services in the field of psychology. 13 * Sec. 2. AS 08.86.180(b) is amended to read: 14 (b) This section does not apply to

01 (1) a person employed by a governmental unit, educational institution 02 or private agency who may be required to engage in some phase of work of a 03 psychological nature in the course of the person's employment, if the employer 04 maintains appropriate supervision of psychological activities and professional conduct, 05 and if the person is performing the psychological activities as part of the duties for 06 which the person was employed, is performing the activities solely within the facilities 07 of the organization in which the person is employed or under the supervision of the 08 organization in which the person is employed, and does not render or offer to render 09 psychological services to the public for compensation in addition to the salary the 10 person receives from the organization; 11 (2) a student, intern, or resident in psychology pursuing a course of 12 study approved by the board as qualifying training and experience for a psychologist, 13 if that person's activities constitute a part of that person's supervised course of study 14 and that person is designated by titles such as "psychology intern" or "psychology 15 trainee"; 16 (3) a qualified member of another profession, in doing work of a 17 psychological nature consistent with that person's training and consistent with the code 18 of ethics of that person's profession, if the person does not hold out to the public by a 19 title or description of services incorporating the words "psychology," "psychological," 20 "psychologist," "psychometry," ["PSYCHOTHERAPY," 21 "PSYCHOTHERAPEUTIC," "PSYCHOTHERAPIST,"] "psychoanalysis," or 22 "psychoanalyst" or represent to be trained, experienced, or qualified to render services 23 in the field of psychology; [.] 24 (4) [REPEALED. 25 (5)] a physician engaged in the normal practice of medicine for which 26 the physician is licensed under AS 08.64. 27 * Sec. 3. AS 08.86.180(d) is repealed.
