00 SENATE BILL NO. 146 01 "An Act relating to indemnity agreements between public entities in the state." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 09.17 is amended by adding a new section to read: 04 Sec. 09.17.200. Indemnity agreements between public entities. (a) A 05 provision, clause, covenant, or agreement by a public entity in the state that purports to 06 indemnify, defend, or hold harmless another public entity in the state against liability 07 for damages is against public policy and is void and unenforceable. 08 (b) In this section, "public entity" means an entity of the state or of a political 09 subdivision of the state that receives funds appropriated by the legislature or the 10 governing body of a municipality in the state. In this subsection, "entity" includes an 11 agency, a board or commission, a trust, the University of Alaska, a public authority or 12 corporation, a municipality, a school district, service area, or other governmental unit 13 of the state or a political subdivision of the state. 14 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 15 read:

01 APPLICABILITY. This Act applies to an indemnity agreement between public 02 entities entered into on or after the effective date of this Act.
