01 "An Act relating to labor and sex trafficking."                                                                         
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 11.66 is amended by adding a new section to read:                                                 
04                    Article 4.  Labor and Sex Trafficking.                                                             
05            Sec. 11.66.400.  Labor and sex trafficking.  (a)  A person commits the crime                             
06       of labor and sex trafficking if the person engages in the trafficking of persons for the                          
07       purpose of causing or compelling another to engage in                                                             
08                 (1)  labor or services; or                                                                              
09                 (2)  a commercial sex act.                                                                              
10            (b)  Under (a) of this section, it is not a defense that the victim consented to                             
11       engage in the labor or services or the commercial sex act.                                                        
12            (c)  In this section, "trafficking" means the recruitment, transportation,                                   
13       harboring, enticement, provision, or obtaining, of a person, or benefiting from the                               
14       recruitment, transportation, harboring, enticement, provision, or obtaining of a person                           
15       for the purpose of forcing, coercing, or fraudulently inducing that person to engage in                           

01       labor or services or a commercial sex act by the                                                                  
02                 (1)  use or threat of use of a scheme intended to cause the person to                                   
03       enter the condition of a debtor pledging the person's labor, services, or commercial sex                          
04       acts as a security for debt;                                                                                      
05                 (2)  abuse of the legal process; or                                                                     
06                 (3)  use or threat of use of a scheme intended to cause the person to                                   
07       believe that the person or another person under their control would be the victim of a                            
08       crime if they do not agree to perform the labor, services, or commercial sex acts.                                
09            (d)  Labor and sex trafficking is a class A felony.                                                          
10    * Sec. 2.  AS 44.29.020(a) is amended by adding a new paragraph to read:                                           
11                 (18)  the facilitation of the acquisition of federal funds and programs                                 
12       for the victims of labor and sex trafficking.
