00 SENATE BILL NO. 12 01 "An Act relating to the prohibition or elimination of financial relationships with persons 02 that conduct business in countries that support or ignore slavery and trafficking in 03 persons." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 06 to read: 07 FINDINGS. The legislature finds that 08 (1) the United States Congress enacted 22 U.S.C. 7101 - 7110 (Trafficking 09 Victims Protection Act of 2000); 10 (2) slavery and trafficking in persons for involuntary labor or sexual servitude 11 involve hundreds of thousands of human beings around the world; 12 (3) many women, children, and men are enslaved, raped, brutalized, and killed 13 in the trafficking industry with the compliance or inattention of their governments; 14 (4) the victims of trafficking and commercial sexual exploitation are often

01 unable to escape or resist their captors, are scarred for life if they survive, and often contract 02 acquired immunodeficiency syndrome or HIV symptomatic disease (AIDS) and other 03 sexually transmitted diseases; and 04 (5) many domestic and international organizations conduct business in and 05 with countries that support or ignore slavery and trafficking in persons. 06 * Sec. 2. AS 36.30.020 is amended to read: 07 Sec. 36.30.020. Legislature. The legislative council shall adopt and publish 08 procedures to govern the procurement of supplies, services, professional services, and 09 construction by the legislative branch. The procedures must be based on the 10 competitive principles consistent with this chapter and must be adapted to the special 11 needs of the legislative branch as determined by the legislative council. The 12 procedures may contain provisions for prohibiting or eliminating financial 13 relationships with organizations that conduct business in countries listed in Tier 14 3 of the most recent Trafficking in Persons Report published by the United States 15 Department of State or other list of countries prepared by the United States 16 Secretary of State under 22 U.S.C. 7107(b)(1)(C). The procedures must be 17 consistent with the provisions of AS 36.30.080(c) - (e) and 36.30.085. 18 Notwithstanding the other provisions of this section, the legislative agencies subject to 19 the legislative council's regulations shall comply with AS 36.30.170(b). 20 * Sec. 3. AS 36.30.030 is amended to read: 21 Sec. 36.30.030. Court system. The administrative director of courts shall 22 adopt and publish procedures to govern the procurement of supplies, services, 23 professional services, and construction by the judicial branch. The procedures must be 24 based on the competitive principles consistent with this chapter and must be adapted to 25 the special needs of the judicial branch as determined by the administrative director of 26 courts. The procedures may contain provisions for prohibiting or eliminating 27 financial relationships with organizations that conduct business in countries 28 listed in Tier 3 of the most recent Trafficking in Persons Report published by the 29 United States Department of State or other list of countries prepared by the 30 United States Secretary of State under 22 U.S.C. 7107(b)(1)(C). The procedures 31 must be consistent with the provisions of AS 36.30.080(c) - (e) and 36.30.085.

01 Notwithstanding the other provisions of this section, the judicial branch shall comply 02 with AS 36.30.170(b). 03 * Sec. 4. AS 36.30.040(a) is amended to read: 04 (a) The commissioner shall adopt regulations governing the procurement, 05 management, and control of supplies, services, professional services, and construction 06 by agencies. The regulations may contain provisions for prohibiting or 07 eliminating financial relationships with organizations that conduct business in 08 countries listed in Tier 3 of the most recent Trafficking in Persons Report 09 published by the United States Department of State or other list of countries 10 prepared by the United States Secretary of State under 22 U.S.C. 7107(b)(1)(C). 11 The commissioner may audit and monitor the implementation of the regulations and 12 the requirements of this chapter with respect to using agencies.
