00 HOUSE BILL NO. 288 01 "An Act relating to the Medicaid personal needs allowance for assisted living home 02 residents; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.07.020 is amended by adding a new subsection to read: 05 (j) The department shall establish a monthly income limit under (b)(6) of this 06 section that excludes a personal needs allowance in the amount of $260 for an eligible 07 recipient who is residing in an assisted living home. 08 * Sec. 2. 7 AAC 43.1058(k)(1)(B) is annulled. 09 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 EMERGENCY REGULATIONS. The need to adopt regulations consistent with this 12 Act is declared an emergency, and the Department of Health and Social Services shall 13 proceed to adopt emergency regulations to implement a personal needs allowance of $260 for 14 all eligible recipients of medical assistance who reside in an assisted living home.
01 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 02 read: 03 RETROACTIVITY. (a) If, under sec. 5 of this Act, this Act takes effect on or after 04 July 1, 2005, sec. 1 of this Act is retroactive to July 1, 2005. 05 (b) If, under sec. 5 of this Act, this Act takes effect on or after July 2, 2005, section 2 06 of this Act is retroactive to July 2, 2005. 07 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
